The state court of appeals Tuesday said a judge wrongly dismissed two first-degree murder counts against a man accused of shooting a woman who was five months pregnant, resulting in the loss of her unborn twins.  The shooting happened in 2008, 3 years before passage of a law which makes the killing of a fetus a homicide. In 2010, a judge ruled the twins were too undeveloped to survive outside the womb.  It's not clear whether murder charges will now be refiled against the defendant.
